Terms and Conditions of Use Teritoria
These terms and conditions govern relations between TERITORIA, a public limited company with a Board of Directors and share capital of €99,500, whose registered office is located at 1-3 Immeuble Bords De Seine, 1 Esplanade du Foncet 92130 Issy-Les-Moulineaux, registered with the Nanterre Trade and Companies Register under number 382 256 857 (’ TERITORIA “) and any user of the website accessible at www.teritoria.com (” the User ’).
TERITORIA is a subsidiary of the MAJORIAN Group, which specialises in hospitality and catering. For more than thirty years, it has created and run a network of independent hotels and restaurants(the ‘ Establishments “) which pursue a certain level of quality and whose philosophy is based on shared values (hereinafter the ” Teritoria Network ’).
The purpose of the website www.teritoria.com (the ’ Site ’) is to enable Users to access the presentation of the Establishments and the editorial content published by TERITORIA and to benefit from the services provided by TERITORIA VOYAGES, a subsidiary of the MAJORIAN Group, in connection with the Establishments.
Any use of the Site implies unreserved acceptance of these General Conditions of Use, the content of which TERITORIA reserves the right to adapt or modify at any time.
1. Purpose of these General Terms and Conditions of Use
The purpose of these General Conditions of Use is to govern the conditions under which TERITORIA allows Users of the Site :
- access the presentation of establishments that are members of the Teritoria Network, and, where applicable, have access to the online booking tool provided by their operators;
- benefit from editorial content produced by TERITORIA and/or its partners;
- access to the events and seminars organisation service offered by TERITORIA VOYAGES.
The conditions relating to the other products and services offered through the Site by TERITORIA VOYAGES (sales of gift boxes and gift cards and loyalty programme) are available in our Teritoria General Terms and Conditions of Sale.
2. Presentation of establishments
The Site gives the User free access to the presentation of establishments that are members of the Teritoria Network. This presentation is based on geographical criteria (countries, regions, towns), criteria linked to the category of Establishment concerned (hotels, hotel-restaurants, restaurants, guest houses) and various classification filters (spa, swimming pool, Michelin-starred chef, etc.).
The Site also gives the User free access, where applicable, to the booking tool set up by the operator of each Establishment concerned. This access is provided by a link to the page on the site of the Establishment providing access to the reservation tool set up by the operator, it being specified that reservations made in this context do not give rise to the payment of a commission to TERITORIA. TERITORIA does not intervene in any way in the reservation process, the contract relating to any reservation within an Establishment being concluded directly between the User and the operator of the Establishment selected by the latter. TERITORIA gives no guarantee as to the existence, terms and conditions of use of the reservation tool provided, where applicable, by the operators of the Establishments.
TERITORIA pays particular attention to the quality of the information relating to the Establishments presented on the Site but in no way guarantees the accuracy or updating of this information. In this respect, information relating in particular to prices, availability and facilities offered by the Establishments is the sole responsibility of their operators.
It is the User’s responsibility to check, when booking services directly with each Establishment, the relevant conditions, particularly in terms of cancellation policy, payment and no-shows.
The Establishments are also presented in a printed and digital guide (the ‘Guide’). Users can download the digital version of the Guide by completing the form provided on the Site.
3. Editorial content
The Site gives the User free access to editorial content relating to the activities of the Establishments and the values promoted by the Teritoria Network (the ‘Editorial Content’).
3.1. Articles published on the Site
Editorial Content may take the form of articles published by TERITORIA or its partners and published online on the Site. These articles can be shared by the User by email or through his social networks.
3.2. Dedicated Journals
The Editorial Content may take the form of magazines devoted to different themes (Travel, Culinary, Portrait, Regions, etc.) published by TERITORIA or its partners at regular intervals in paper and/or digital form (the ‘Dedicated Magazines’). The User can obtain a downloadable version of the Dedicated Reviews in digital format by making a request using the form provided for this purpose on the Site.
3.3. Newsletter
The Editorial Content may take the form of newsletters on various topics (news, discovering the regions, portraits of our members, travellers, etc.) published by TERITORIA or its partners and sent to Users in electronic format (the ‘Newsletter’). The User may subscribe to the Newsletter by making a request using the form provided for this purpose on the Site. Users may cancel their subscription to the Newsletter at any time under the conditions set out in the https://www.teritoria.com/politique-de-confidentialite-et-cookies/ confidentiality policy.
4. Organisation of events and seminars
The Site enables the User to contact the TERITORIA VOYAGES team dedicated to the organisation of events and seminars in a number of establishments in the Teritoria Network, using a form dedicated to this purpose (or by telephone).
As part of this activity, TERITORIA VOYAGES identifies the User’s needs, lists the Establishments in the Teritoria Network likely to meet these needs, solicits offers of services from them, and in the event that these offers attract the User’s attention, puts the User in contact with the operators of the Establishments concerned.
Contracts relating to the organisation of events and seminars are concluded, where applicable, directly between the User and the operator of the Establishment concerned without TERITORIA VOYAGES being held liable in any way whatsoever. TERITORIA VOYAGES declines all liability in the event of damage suffered by the User in the context of the organisation of an event or seminar within the Establishment concerned.
In the event that the User enters into an agreement with the operator of one or other of the Establishments offered by TERITORIA VOYAGES, TERITORIA VOYAGES shall receive remuneration from the latter.
5. Opening an account
The Site allows the User to create an account (the ‘ Account ’) enabling him to draw up a list of Establishments he would like to visit (wishlist), to have access to his purchase history of gift packs and gift cards, to subscribe to the extension of his gift packs and gift cards, and to access the loyalty programme.)
The process of creating an Account involves the User providing the following data:

Once registration has been completed, the User will receive an e-mail at the address provided confirming the creation of their Account.
It is the User’s responsibility to ensure the strict confidentiality of his/her login and password. Any use of the Site made with the User’s login and password will be deemed to have been made by the User or with the User’s consent, which the User expressly acknowledges and accepts.
6. Liability
6.1 Information about establishments – Editorial content
TERITORIA endeavours to present the Establishments in an objective and reliable manner, but cannot guarantee that this presentation is free from defects, errors or omissions.
Therefore, the information relating to the Establishments is presented for information purposes only and has no contractual value. In particular, the photographs and texts reproduced on the Site in connection with the Establishments are not contractual. Consequently, TERITORIA cannot be held responsible for any error in one of these photographs or texts.
The Editorial Content, as well as any other information appearing on the Site, is not intended to constitute advice on the basis of which a purchasing decision could be made by the User.
TERITORIA accepts no responsibility for the reliance placed by any User of the Site on such data and information. The User must not under any circumstances take it for granted that the presentation of the Establishments, the Editorial Content or other information presented on the Site is accurate or up to date, but must independently verify all such information for himself.
In particular, TERITORIA may not be held liable for any damage whatsoever relating to the products and/or services provided in the Establishments or for any failure by the operators of the Establishments to fulfil their obligations in connection with bookings made by the User.
The User uses the Site at his own risk and under his sole responsibility. TERITORIA cannot guarantee in any way that the Site and the services provided through the Site will not be interrupted. The obligation to provide the Site and its services is limited to an obligation of means.
Neither TERITORIA nor any of its partners (and in particular TERITORIA VOYAGES) may be held liable for any direct or indirect damage that may result from errors, omissions or delays in the transmission of information on the Site.
6.2. Availability of the Site
In principle, the Site is accessible 24 hours a day, 7 days a week, except in the event of scheduled or unscheduled interruptions for maintenance purposes or in cases of force majeure.
TERITORIA does not, however, offer any guarantee as to the conditions of use of the Site and cannot be held liable for any damage whatsoever resulting from the unavailability of the Site or of one or more of the services offered by the Site. TERITORIA cannot be held responsible for any viruses that may infect the computer or any other hardware of the User, following use, access or downloading from the Site.
7. Intellectual Property
The texts, photographs, trademarks and other elements appearing on the Site and more generally in all Editorial Content (hereinafter together the ‘ Elements ’) are protected by intellectual property rights held by TERITORIA or its partners.
Use of the Elements by the User must be strictly limited to private use, to the exclusion of any commercial use.
The User is prohibited from reproducing and/or using the Elements in any way whatsoever, and in particular from modifying, copying, translating, reproducing, selling, publishing, exploiting and distributing them in digital or other format, in whole or in part.
The User acknowledges that the Site and the services offered through the Site consist of several databases, made available by TERITORIA, as producer of said databases within the meaning of Articles L.341-1 et seq. of the Intellectual Property Code. Accordingly, the User, pursuant to these provisions, also refrains from proceeding, in any way whatsoever, to any extraction, use for any purpose whatsoever, storage, reproduction, representation to the public or conservation, direct or indirect, partial or total, including in memory buffer or temporary, qualitatively or quantitatively substantial content of one or more databases of the Site.
In addition, the User agrees not, without the prior written permission of TERITORIA, to collect, store, use, extract, reproduce, directly or indirectly, all or part of the content of the Site, automatically by any means and in particular by the use of robots, software or any other automatic devices for commercial purposes and in particular for the purpose of feeding, training and developing any software based on artificial intelligence.
To this end, TERITORIA reserves the right to implement any means of protection on the Site that it deems necessary in order to prevent and block any unauthorised use of the Site as mentioned above, in particular through the implementation of technical blocking measures.
Violation of these mandatory provisions subjects the offender, and all persons responsible, to the criminal and civil penalties provided for by law.
TERITORIA and/or its partners are the exclusive holders of all intellectual property rights attached to the names, logos and trademarks reproduced on the Site, its structure and layout, databases and Editorial Content throughout the world.
8. Applicable texts- Jurisdiction
These General Terms and Conditions of Use are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
9. Mediation
In the event of any difficulty relating to the application of these General Terms and Conditions of Use, the User may have recourse to TERITORIA’s consumer mediator: Médiateur du Tourisme et du Voyage.
The User may refer the matter free of charge to the Tourism and Travel Ombudsman, whose contact details and procedures are available on its website: www.mtv.travel.
In addition, in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform to facilitate the independent out-of-court settlement of online disputes between consumers and professionals in the European Union.
